Club Concierge® – General Service Terms and Conditions

These General Terms and Conditions (“Terms”) govern all services rendered by Club Concierge®, its platforms, teams, and partners, across all channels—digital, telephonic, in-person, or otherwise. By engaging with our services, the Client/User irrevocably agrees to be bound by the following:

1. Scope of Services

Club Concierge® provides lifestyle management and concierge services by arranging access to exclusive third-party offerings across travel, hospitality, events, wellness, gifting, clubs, and experiences. Club Concierge® acts only as an intermediary, not a direct provider, and makes no guarantees on service quality, availability, or performance by third parties.

2. Absolute User Obligations

The Client must:

  • Provide complete, accurate, and timely information.

  • Use services strictly within legal and ethical limits.

  • Refrain from making unreasonable, unlawful, or misleading requests.

  • Promptly pay for all third-party costs, penalties, and associated charges.

Failure to comply empowers Club Concierge® to immediately terminate services without refund or liability.

3. Non-Negotiable Confidentiality

All client data, service requests, preferences, and identity-related information are treated as strictly confidential. Unauthorized sharing, copying, or misrepresentation of our platforms, service workflows, or proprietary tools is strictly prohibited and may result in legal action, including injunctions and damages.

4. Indemnity – Full Protection for Club Concierge®

The Client agrees to fully indemnify, defend, and hold harmless Club Concierge®, its directors, employees, partners, and affiliates from and against any and all claims, liabilities, damages, losses, or costs (including legal fees) arising from:

  • Any breach of these Terms,

  • Any misuse, misrepresentation, or unlawful usage of services,

  • Any third-party claim tied to a transaction initiated through our platform.

 

5. Limitation of Liability

Club Concierge® shall not be liable for:

  • Acts or omissions of third-party service providers;

  • Indirect, incidental, punitive, or consequential damages;

  • Unavailability, miscommunication, or interruptions;

  • Any damages exceeding INR 100 in total, regardless of the claim’s basis.

All services are rendered “as-is” and “as-available”.

 

6. Service Fulfilment & SLA

  • 95% of qualified requests fulfilled within 24 business hours.

  • Delays due to third-party coordination, user inaction, or force majeure events shall not be counted as SLA failures.

  • SLA benchmarks are defined separately and maintained in Annexure 1.

Club Concierge® alone shall assess and determine if an SLA breach has occurred. This determination shall be final and binding.

 

7. CRM & Communication Costs

  • CRM software (e.g., Zoho) licenses shall be procured and maintained by the Client.

  • Any custom CRM development or third-party integrations shall be handled by Zoho and charged separately.

  • Telephony infrastructure (including annual service charges and international call reimbursements) must be funded in full by the Client against submitted invoices or actuals.

 

8. Intellectual Property & Trademark Enforcement

Club Concierge® holds exclusive rights to the term “Concierge” in India. Any unauthorized use of our name, system, brand, app design, templates, or service frameworks will trigger immediate legal recourse under trademark and copyright laws.

 

9. Cancellation, Refunds, and Pricing Adjustments

  • All cancellations or refunds are governed by third-party terms.

  • Club Concierge® is not liable to offer or mediate refunds.

  • Annual price revisions (post Year One) will be mutually agreed upwardly and documented prior to renewal.

 

10. Force Majeure

Club Concierge® shall not be held liable for any service delays or failures caused by events beyond its control, including but not limited to:

  • Acts of God, floods, earthquakes

  • War, civil unrest, terrorism

  • Pandemic-related restrictions

  • Governmental mandates or service shutdowns

All valid complaints will be acknowledged within 48 hours and resolved within 15 working days.

 

12. Dispute Resolution & Jurisdiction

All disputes shall be settled via arbitration under the Arbitration and Conciliation Act, 1996, with Club Concierge® appointing the sole arbitrator. Seat and venue: Bangalore, India. Language: English.

 

13. Binding Nature

Use of any Club Concierge® service indicates unconditional acceptance of these Terms. These Terms override all previous understandings or verbal representations and remain binding until explicitly superseded in writing.

 

Club Concierge® – App Terms & Conditions

Welcome to the Club Concierge® App – your gateway to curated access, privileges, and experiences. By accessing, browsing, or using this app, you agree to comply with and be bound by the following Terms & Conditions. Please read them carefully. If you do not agree, do not use the app.

 

1. Service Overview

The Club Concierge® App is a digital concierge platform connecting users to premium services, including but not limited to:

  • Club Access: Social, golf, athletic, country, and international clubs

  • Dining: Fine dining, bar reservations, chef’s tables

  • Stays & Travel: Hotel bookings, luxury escapes, curated journeys

  • Events & Lifestyle: Art, theatre, music, sports, fashion, wellness

  • Personal Assistance: Gifting, home services, visas, transport, legal & financial advisory

All services are offered via third-party providers, with Club Concierge® acting solely as a facilitator.

2. User Eligibility & Conduct

  • You must be at least 18 years of age or have legal guardian consent.

  • You are responsible for maintaining confidentiality of your login credentials.

  • You may not use the app for unlawful or fraudulent purposes.

  • Any misuse, abusive behavior, or false requests will result in suspension.

 

3. Nature of Services

  • Club Concierge® acts as an intermediary between you and various third-party service providers.

  • We do not own, operate, or control the services you book through the app.

  • All bookings, transactions, and engagements are subject to availability and provider terms.

 

4. Service Fees & Payment

  • Some services may require advance payment or deposits directly to third-party vendors.

  • All charges related to services are to be borne by you, including international telephony, reservations, handling fees, and cancellation penalties (where applicable).

  • Any custom CRM licenses (e.g., Zoho) used for user service are billable if applicable.

 

5. Telephony & CRM Terms

  • Telephony-related charges, such as international calls made on your behalf, are reimbursable by you at actuals.

  • Club Concierge may use CRM tools (such as Zoho); licenses and customizations are managed by third parties and are the responsibility of the client or account holder.

 

6. Intellectual Property

  • The term "concierge" is a registered trademark of Club Concierge® in India.

  • All content, branding, UI, and user data architecture are protected by intellectual property laws.

  • You may not copy, replicate, or reverse-engineer any part of the app.

 

7. Limitation of Liability

  • Club Concierge® is not responsible for delays, service failures, or damages caused by third-party providers.

  • Our total liability, under any circumstance, shall not exceed INR 100.

  • The app is provided “as is,” without warranties of any kind.

 

8. Indemnity

You agree to indemnify and hold harmless Club Concierge®, its officers, employees, and partners from any liability, loss, or claim arising out of:

  • Your misuse of the app

  • Breach of these terms

  • Disputes with vendors

  • Errors in information provided by you

 

9. Modifications & Termination

  • We reserve the right to modify these terms, services, or the app interface at any time.

  • Continued use of the app signifies your acceptance of the latest version.

  • We may suspend or terminate your access without notice for violation of any terms.

 

10. Governing Law & Jurisdiction

  • These Terms are governed by Indian law.

  • Any disputes shall be subject to the exclusive jurisdiction of the courts in Bangalore, India.

 

11. Force Majeure

Club Concierge® shall not be liable for failure to deliver services caused by circumstances beyond its control, including but not limited to:

  • Acts of God, pandemics, war, or terrorism

  • Natural disasters, strikes, internet outages

  • Government regulations or lockdowns

 

12. Privacy

Your data is protected by our Privacy Policy which governs collection, use, and retention. By using the app, you consent to our data practices.

13. Children’s Policy

  • Users under the age of 13 are not permitted to use the app.

  • We do not knowingly collect data from minors. Parents may contact us to delete such data if unintentionally collected.

However, Club Concierge® shall not be held liable for penalties, claims, or obligations arising from overly broad, ambiguous, or retroactive interpretations of data security laws, particularly where:

  • Such laws impose unreasonable or disproportionate liabilities for breaches not caused by Club Concierge’s negligence;

  • Requirements go beyond what is reasonably practicable or industry-standard, especially in fast-evolving digital and regulatory environments;

  • Breaches or claims arise due to actions or omissions by third-party platforms, hosting providers, or service integrators outside Club Concierge’s direct control;

  • Data disclosures are required by law enforcement, governmental authorities, or regulatory bodies, in compliance with applicable law.

 

Club Concierge® reserves the right to revise or restrict services in jurisdictions where compliance with data security laws imposes excessive or impractical obligations.
